It is stated that another Second Appeal bearing Second Appeal No. 1051/2000 out of the same judgment and decree is pending in between 'Pawan Singh and others Vs. Budhwar Singh and others' and the judgment and decree is dated 12/08/2000 passed in Civil Appeal No. 31-A/1999 and therefore this may be linked.

Perused the application wherein the judgment and decree dated 12/08/2000 has been stated to be passed in Civil Appeal which is under challenged in Second Appeal No. 1051/2000. Here in the instant case, the judgment and decree which is under challenged is of 24/08/2000 and therefore prima facie it appears that it is a different case. Even otherwise, the case is not heard on admission, therefore, the case is heard on admission.

Accordingly, the application is dismissed.
