1. Learned counsel for the appellant submits that since after passing of the impugned Order, both the parties are residing together. Thus, application for custody of the minor has been rendered infructuous.

2. In view of the statement made by the learned counsel for the appellant, the appeal is dismissed as infructuous reserving liberty in favour of the appellant to revive the appeal if the cause of action subsist.

3. Accordingly, the present FAM is dismissed as infructuous with the aforesaid liberty.
