1. The complainant Omprakash is present before this Court on notice along with his counsel and he has made a statement that he has objection in grant of bail to the applicant.

2. After arguing for some time, learned counsel for the applicant seeks permission of this Court to withdraw this application filed under Section 439 of Cr.P.C and also liberty to file repeat application after examination of prosecutrix in trial.

3. It is ordered as prayed for.
