1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 261/2017 registered at Police Station D.D. Nagar, Raipur (C.G) for the offences punishable under Sections 294, 323, 324, 506, 327 of IPC.
2. As per the prosecution case, on 12.10.2017 the complainant Vinod Dewangan was in a hotel, at that time, the applicant came there and demanded money for consuming liquor. Having refused, he was assaulted by way of knife and in the said incident, the brother of the applicant also joined, thereby the offence has been committed.
3. Learned counsel for the applicant submits that applicant has been falsely implicated in this case and no allegations can be attributed to him, therefore, the applicant may be enlarged on bail.
4. Per contra, learned State Counsel opposes the bail
application.
5. Perused the order wherein it records that the cases of similar nature stand registered against the applicant in the police station under the different provisions of IPC and also excise matters. Taking into consideration such facts and the past antecedents, I am not inclined to allow this bail application. Accordingly, it is rejected.
