Versus

1. State Of Chhattisgarh Through Secretary, Department Of Forest, Mahanadi Bhawan, New Mantralaya, Raipur, Chhattisgarh.

2. Principle Chief Conservator Of Forest, Department Of Forest Jail Road, Raipur, District Raipur, Chhattisgarh.

3. Chief Conservator Of Forest, Bilaspur Circle District Bilaspur, Chhattisgarh.

4. Divisional Forest Officer, Forest Division Mungeli, Chhattisgarh. ----Respondents For Petitioner :

Mr. F.S. Khare, Advocate For State :

Mr. Shashank Thakur, Govt. Advocate Hon'ble Shri Justice P. Sam Koshy Order on Board 20/07/2018

1. The grievance of the petitioner is that the petitioner is a handicapped son of the deceased employee Omkar Das Purle, who died in harness on 09.03.2015 from the Forest Department on the post of Deputy Ranger.

2. The contention of the petitioner is that since the petitioner is physically challenged under the provisions of Sub-Rule 6 of Rule 47 of the Chhattisgarh Civil Services Pension Rules, 1976, the petitioner is entitled for the share in the pension which is payable to the family members of the deceased and though the respondents have already processed the case of the petitioner, but the same has not yet been finalized. The document (Exhibit P/7) shows that the respondent No.4 has in fact as late as on 10.07.2017 has forwarded the case to the

respondent No.3 for necessary approvals so that the claim of pension of the petitioner be decided at the earliest.

3. Given the aforesaid facts and circumstances of the case and the letter dated 10.07.2017 of the respondent No.4, this Court does not intend to keep the petition pending, rather ends of justice would serve if the respondents No. 3 & 4 are directed to ensure that the case of the petitioner for grant of pension is processed and finalized at the earliest preferably within a period of 45 days from the date of receipt of the order of this Court.

4. With the aforesaid observations the present writ petition stands disposed off.
