The applicant has been arrested in connection with Crime No.110/2017 registered at Police Station- Sariya, District - Raigarh (C.G.) for alleged commission of offence under Sections 376, 450, 506 of IPC. 2.
Case of the prosecution is that the applicant entered the house of the prosecutrix in the night and committed rape on her. 3.
Learned counsel for the applicant would submit that the story of the prosecution is highly improbable and smacks of false implication. In the alternative, it is submitted that the manner in which she narrated the story and that she did not disclose the incident to her mother-in-law shows that it could be a case of consent and only when, the case was disclosed, report has been lodged. 4.
On the other hand, learned State counsel submits that the prosecutrix has clearly stated in her statement that the applicant arrived in the house of the prosecutrix in the night and switched off lantern and committed rape on her and she was threatened, if she discloses the incident.
