1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 114/2017 registered at Police Station Premnagar, Distt. Surajpur (C.G) for the offences punishable under Section 420 of IPC.

2. As per the prosecution case, in the year 2004-2005 the applicant allured different villagers to return the money with lucrative interest and on such allurement collected huge sum of Rs.1,25,74,000/- from different villagers. Though for certain period of time the interest was paid thereafter the applicant failed to pay back the amounts of depositors, thereby offence has been committed. It is also alleged that During the course of investigation, the register was seized from the possession of the applicant which shows that the applicant was maintaining the accounts.

3. Learned counsel for the applicant submits that the charge

sheet contains the statements of Geeta Rajawade, Rahul, Sukhmania who are shown to be minors and if the time of incident which took place in the year 2004-2005 is taken into account, they were not borne at the relevant time, therefore, false allegations have been attributed.

4. Learned State counsel opposes the bail application.

5. Considering the nature of allegations and the way the appellant has collected the amounts from different villagers by giving false data, I am not inclined to allow this bail application. Accordingly, it is rejected.
