The instant petition has been filed for the following reliefs: (i) To kindly direct the respondent No.1 and 2, promote/ appoint the petitioner on the post of Scale-II from Scale-I in respect of the promotion from waiting list (Annexure P-2).

(ii) To kindly make any other order that may be deemed fit and just in the facts and circumstances of the case.

The petition is of 2011. The contention of the petitioner is that the petitioner successfully appeared for promotion to Scale-II post and cleared the examination as the petitioner had held Scale-I post. Subsequently, after the petitioner cleared his examination for promotion, he was kept in the waiting list and the grievance of the petitioner is that thereafter the petitioner has not been considered and given the promotion.

The respondent's counsel submits that subsequently with the change of time, Sarguja Kshetriya Gramin Bank is merged with Chhattisgarh Rajya Gramin Bank and the waiting list was only was for 1 year; therefore, no right can be conferred as on date. It is stated within 1 year, no person either from the waiting list were promoted to cause any discrimination. 4.

Perusal of promotional list would show that the petitioner's name was placed at serial No.5 in the waiting list. It is not the case that above four persons before him are promoted. Categorically the waiting list shows that the list would survive up till 31.03.2011. Consequently, when the list has already lived its life and expired, the same cannot be revived. Therefore, at this stage, no relief can be granted to the petitioner. 5.
