1. The applicant has preferred this first bail application under Section 439 of Cr.P.C. as he is in jail since 09.12.2020 in connection with Crime No. 218/2020 registered in Police Station Pithoura, District Mahasamund (C.G.) for the offence punishable under Section 398 of IPC.

2. Learned counsel for the applicant seeks to withdraw this application with liberty to file a fresh application if trial is not concluded within a period of four months from today.

3. Accordingly, the application is disposed of as withdrawn with the liberty as stated above.
