This is the first bail application under Section 439 of the CrPC and there is no bail application is pending before any other Court. 2.

Case diary is not produced. Photocopy of charge-sheet produced by the counsel for the applicant in connection with Crime No.364/2018 registered in Police Station Manendragarh, District Korea (C.G.) for the offence punishable under Section 34(2) of CG Excise Act. 3.

Argument heard.

Case of the prosecution, in brief is that on 29/10/2018, 10 bulk liters of hand made country liquor has been seized from the possession of the applicant. 5.

As per photocopy of the memo of arrest which is part of the charge-sheet counsel for the State submits that there is no antecedents against him. 6.

Looking to the above facts and circumstances of the case, the application is allowed. It is directed that if the applicant furnishes one solvent surety for a sum of Rs. 25,000/- along with one personal bond of Rs. 25,000/- to the satisfaction of the trial Court concerned, he be released on bail. 7.
