2. Mr. Anup Majumdar, learned counsel for the petitioner, would submit that though the petitioner has been promoted by order dated 15/09/2008 (Annexure P/1) on the post of Upper Division

Teacher after the order passed by this Court in WPS No. 758/2007 and he joined on the promoted post on 16/09/2008, but immediately thereafter he made a representation on 23/10/2008 (Anneuxre P/5) for granting seniority on the post of Upper Division Teacher with effect from the year 1993, but it has not been considered by respondent No. 2 till date, therefore, appropriate direction be issued to respondent No. 2 to consider and decide petitioner's representation in accordance with law by passing a reasonable and speaking order.

Be that as it may, respondent No. 2 is directed to consider and decide petitioner's representation dated 23/10/2008 (Anneuxre P/5) by passing a reasoned and speaking order within 60 days from the date of receipt of a copy of this order. Petitioner is at liberty to file additional representation (if any) within two weeks from today.

4. With the aforesaid direction, this writ petition stands disposed of. No cost(s).
