This Revision Petition has been preferred by the defendants under Section 115 of the Code of Civil Procedure, 1908 (hereinafter referred to as the CPC) questioning the legality and propriety of the order dated 20.11.2019 passed by the learned trial Court whereby the application preferred by the defendants under Order 7 Rule 11 of CPC has been rejected. 3.
At the outset, it appears from a perusal of the Order impugned, the
concerned trial Court has framed the issues pertaining to the valuation of the suit as well as the jurisdiction of it, in pursuance to the directions contained in order dated 31.08.2018 passed in Civil Appeal No.15-A/2018 by the appellate Court. Since the relevant issues have already been framed and the trial Court has to decide the same as per the directions contained therein, therefore, I am not inclined to entertain this Revision Petition at this stage. However, learned counsel for the applicants may apply before the concerned trial Court for the disposal of those issues as preliminary issues. 4.
With the aforesaid observation, the Revision Petition is dismissed at the admission stage itself.
