The limited grievance that the petitioner has in the present writ petition is the non granting of regular pay scale on completion of 3 years of service at collector rate fixed by the authorities. 2.

According to the petitioner he was initially appointed on 29.01.1990 as Chowkidar vide Annexure P-1 wherein it was specifically held that engagement of the petitioner was at the rate fixed by the

District Collector. Subsequently, Annexure P-2 is a document which shows that petitioner has been given benefit of regular pay scale w.e.f. 31.08.1998 with a reference that same is awarded on account of petitioner having continuously worked for a period of 3 years at the collector rate. Claim of the petitioner is that the said regular pay scale ought to had been paid to the petitioner on completion of 3 years of service i.e. from the year 1993 onwards which in the instant case has been given to the petitioner only w.e.f. 1998.

Given the said factual matrix of the case and also taking note of the fact that claim of the petitioner is still pending consideration before respondent no.2 & 3, the writ petition at this juncture stands disposed of directing the respondent no.2 & 3 to take a decision in accordance with law at the earliest preferably within a period of 90 days.

It is made clear that this Court has not expressed any opinion on the merits of the case, the entitlement of the petitioner shall be purely on the basis of the rules and policies governing the field. 5.

With the aforesaid observations, the present writ petition stands disposed of.
