This is repeat bail application for grant of bail filed by the applicant mainly on the ground of long pre-trial detention of 11 months and that trial has not been concluded.

Learned counsel for the applicant would add that though the allegation is of assault by an axe on the head and there is fracture injury, report of doctor does not show that it would have resulted in death. 3.

On the other hand, learned State counsel opposes the prayer and submits that earlier bail application has been rejected on merits, it is a case of assault on head and fracture injury which is said to be grievous in nature. 4.

Taking into consideration the nature of allegation, weapon used, nature of injury placed on the body where the injury was given, at this stage, no case is made out for grant of bail. The application is therefore rejected. Sd/- (Manindra Mohan Shrivastava) Judge Rekha
