For Respondents/State :

Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 12/01/18 1.

Being aggrieved by the impugned order of the Tahsildar passed on 14.12.2017 for removing the encroachment, this writ petition has been preferred by the petitioner.

2.

Learned counsel appearing on behalf of the petitioner would submit that the impugned order is unsustainable and bad in law as the petitioner's land bearing Khasra No. 1434/1, 1434/3 and 1435/2 is not the disputed land and, therefore, the impugned order be set aside. 3.

I have heard learned counsel for the petitioner.

4.

Be that as it may, since the impugned order is appealable the petitioner is at liberty to prefer an appeal against the impugned order before the competent authority and if such an appeal is preferred by the petitioner then, the Appellate Authority shall consider and decide the same expeditiously.

5.

With the aforesaid observation, the writ petition stands finally disposed of. No order as to cost(s).
