1. Learned counsel for the petitioner submits that petitioner was appointed on the post of Assistant Teacher at Higher Secondary School, Ramanuj Ganj, District Surguja, C.G., Department of Tribal Development, Surguja. He has been transferred on his own request to Block Development Kharsia and District Raigarh, C.G. and thereafter, petitioner was posted in various schools in Tribal Development Department Raigarh, District Raigarh. He further submits that in the gradation lists published on 01.04.2008 and 01.04.2009 of the Assistant Teacher the name of the petitioner was placed at Sr. Nos.260 and 121 respectively below his juniors for which he may be allowed to make representation / objection for deciding his seniority and the respondent-authority be directed to consider and decide his representation / objection.

2. Learned State counsel submits that

petitioner's representation / objection will be considered and decided in accordance with law.

3. Be that as it may, petitioner is at liberty to make representation / objection for his seniority position in the gradation list and that will be considered and decided by respondents No. 2 & 3 within 8 weeks from the date of receipt of representation in accordance with law.

4. With the aforesaid observation / direction the instant writ petition stands disposed off.
