Shri Harshal Chauhan, Advocate Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 03/04/2018 At the outset, learned counsel for the parties would submit that this petition may be disposed off with similar direction as has been issued by this Court in batch of petitions i.e. WPS No.7126/2017 (Mahendra Kumar Sai v. State of Chhattisgarh and ors) and connected matters decided vide order dated 15/02/2018. 2.
Having considered the submission of learned counsel for the parties, this petition is accordingly disposed off. The order passed by the appellate authority is set aside and the matter is remitted back to the appellate authority to consider each
and every ground raised by the petitioner in his appeal afresh and thereafter, to pass a reasoned and speaking order in accordance with law after hearing the parties within a period of six months from the date of receipt / production of a copy of this order. The petitioner is at liberty to raise additional grounds, if any, supported by the documents, which shall be considered by the appellate authority. The petitioner is also at liberty to move an application for grant of interim relief which shall be decided by the appellate authority within one month from the date of receipt of the application. If the application is moved within one month from today, recovery shall not be made against the petitioner for a period of two months. 3.
