Learned counsel appearing for the revenue would submit that the assessment order for the assessment year 2003-2004 has been passed on 31.12.2010 and there is no change in the return of income and as such the writ petition has now become infructuous.

The aforesaid statement is taken on record and the assessment order dated 31.12.2010 is also placed on record.
