1. Proceedings of this matter have been taken-up through video conferencing.
2. Mr.Anoop Mazumdar, learned counsel for the petitioners, would submit that though the petitioners have passed Bachelor of Engineering (Graduation) from Janardhan Rai Nagar, Rajasthan Vidyapeeth, which is deemed University, but it is not being considered by the State Government and they are not being promoted on the post of Assistant Engineer. He would further submit that the petitioners have made a representation in the shape of notice dated 28.9.2010 (Annexure P-8), which has not been considered
till this date by the State Government.
3. On the other hand, Mr.Ravi Kumar Bhagat, learned Deputy Government Advocate appearing for the respondent/State, would submit that though the petitioners do not have degree from recognized University, but yet the State Government will consider their cases on merits in accordance with law.
4. Be that as it may, the State Government is directed to consider as to whether B.E. decree of the petitioners granted by Janardhan Rai Nagar, Rajasthan Vidyapeeth (Deemed) University is a valid decree or not by passing a reasoned and speaking order and depending upon that, the parties are at liberty to proceed further in accordance with law. The aforesaid order will be passed within two months from the date of receipt of a copy of this order.
5. With the aforesaid observation / direction, the writ petition finally stands disposed of. No cost(s). Sd/- (Sanjay K.Agrawal) Judge B/-
