Bajpai Order On Board 27/11/2015 This petition has been filed as Public Interest Litigation for implementation of scheme of reservation in terms of Section 33 of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995. During pendency of this petition, in other

case titled "Union of India Vs. National Federation of the Blind" certain directions were issued by the Apex Court on 8.10.2013 to all the appropriate government, including the State Governments, to compute reservation of 3% for persons with disabilities against the total number of vacancies in the cadre strength and implement it within three months.

02. Pursuant to indulgence made by this Court, various replies have been filed by the State Government including the compliance report dated 4.9.2015. Along with the said compliance report, a letter dated 25.8.2015 of General Administration Department, State of CG, has been annexed wherein time schedule has been given for filling up the backlog vacancies.

03. Shri Kachhawaha submits that as per the time schedule, by 30th January, 2016 all the vacancies would be computed and filled up by the State Government.

04. Shri Rungta submits that he appreciates the efforts made by the State Government but apprehends that the State Government may not fill up all the posts as per direction of the Supreme Court.

05. Shri Kachhawaha, appearing for the State, submits that the apprehension shown by the petitioner is ill-founded and sincere efforts are being made to ensure compliance of the order of the Supreme Court and to fill up all the vacancies as per the schedule.

06. In view of the affidavit dated 4.9.2015 filed by the State Government and the statement made by the Additional Advocate General, the present petition is disposed of with a direction to the State Government to ensure compliance of the letter dated 25.8.2015.
