In this writ application, the Petitioner is aggrieved by recovery of Rs.67,364/- made on 27.7.2006 alleging that it was done after superannuation on 31.5.2006, but without any liberty to show cause and defend that no wrong payments had been made.

The counter-affidavit in paragraph 8 states that the Petitioner had been promoted from the post of Pradhan Pathak to Lecturer on 3.10.1998 and therefore he was not entitled to the benefit of Fundamental Rule 22 by payfixation.

There is no rejoinder to the counter-affidavit. 5.
