1. The applicant has preferred this application for grant of anticipatory bail as he apprehends his arrest in connection with Crime No.336/2008, registered at Police Station Arjuni, District Dhamtari for offence punishable under Sections 420, 294 and 506/34 of the IPC.

2. The applicant has allegedly obtained payment of Rs.3,60,000/- from the complainant and his brother on promise to arrange employment. However, neither the employment was arranged nor the amount was refunded.

3. In course of investigation, the prosecution has also recovered one forged appointment letter handed over by the accused persons to the complainant.

4. Considering the nature of allegations, I am not inclined to extend the benefit of Section 438 CrPC to the applicant. Accordingly, the application is rejected. However, if the applicant surrenders and applies for regular bail, the jurisdictional Court shall consider and decide the application expeditiously, preferably on the same day.
