1. The applicant has preferred this first bail application under Section 439 of Cr.P.C. as he is in jail since 2-10-2020 in connection with Crime No. 597of 2020 registered in Police Station- Khurshipar, District Durg (CG) for the offence punishable under Section 394 of IPC.

2. State counsel submits that number of criminal antecedents are reported against the present applicant.

3. Learned counsel for the applicant seeks permission of this court to withdraw this bail application with liberty to file afresh as and when occasion arises.

4. Permission is granted.

5. Accordingly, the instant bail application is dismissed as withdrawn with the aforesaid liberty.
