Agrawal Order On Board 22/03/2018 (1) After arguing for fairly long time, counsel for the applicant submits that he may be permitted to withdraw present application for anticipatory bail with liberty to file application under Section 439 of the Code of Criminal Procedure before the trial Court. He prays that a direction may be issued to decide the same expeditiously. (2) Liberty is granted, as prayed for.
(3) Accordingly, the bail application is dismissed as withdrawn with the liberty as aforesaid. However, it is directed that if the applicant moves an application for grant of regular bail before the jurisdictional criminal Court, the Court concerned shall make all endeavour to decide the regular bail application preferably on the same day in accordance with law.
