By this judgment, the criminal appeal filed on behalf of the appellant against the order of conviction and sentence dated 03.09.2007 passed by the 14th Additional Sessions Judge (FTC), Raipur, in Sessions Trial No. 90/2007, whereby and whereunder the trial court has convicted the appellant for commission of offence punishable under Sections 363 and 366 of IPC and sentenced two charges of offence Section 363 of IPC and sentenced RI for 5 years and 5 years and also sentenced RI for one year under Section 366 of IPC along with fine sentences and default sentence for non payment of fine, is being disposed of. 2.

Learned counsel appearing for the appellant submits that this appeal has now become infructuous as the appellant has already been released from jail after serving the entire jail sentence passed by the trial court as the trial court also ordered that all the substantive jail sentences awarded to the appellant shall run concurrently.

For the purpose of appreciation, I have perused the evidence adduced by the prosecution before the trial court.

Learned counsel appearing for the appellant submits that this appeal has now become infructuous as the appellant has already been released from jail after serving the entire jail sentence. Also from perusal of entire evidence adduced by the prosecution before the trial court, I do not find any illegality or impropriety in the judgment of conviction and sentence passed by the trial court. 5.

Consequently, the appeal deserves to be and is hereby dismissed for the reasons indicated hereinabove.
