Heard Learned Counsel for the Petitioner and the Respondent No. 1. 2.

In view of the ground of illegal appointment not having been taken before the Labour Court, the Court is not inclined to test the order of the Labour Court directing reinstatement in that background. The finding is that the Respondent No. 1 has worked for over 12-13 years and was removed in violation of Section 25F of the Industrial Disputes Act, 1947.

The writ petition is dismissed.
