1. The challenge in the present writ petition is to the memo dated 01.01.2020 in respect of some irregularities/misappropriation of funds so far as the construction of houses to the persons under the Pradhan Mantri Gramin Awas Yojna.

2. The solitary contention of the petitioner is that the memo reflects that the alleged irregularities is of the period 2018-19. However, he was not the Sarpanch of the said village during the said period and he in fact was the Sarpanch only during 2010-2015. He submits that the said memo has been issued only to deprive the petitioner from participating in the upcoming Panchayat Election. He submits that he has already filled up his nomination papers on 04.01.2020. It is further contended by the petitioner that he has approached before

the authorities concerned and they have adjourned the matter for the 17th of January, 2020.

3. Given the fact that the Sub-Divisional Officer has now fixed the case for 17th of January, the petitioner is directed to appear before the Sub-Divisional Officer to apprise him of the entire factual matrix of the case with sufficient documentary proof that is available with him and the Sub-Divisional Officer is directed to consider the objection on the very same day so that the petitioner does not suffer any disqualification in the upcoming election.

4. With the aforesaid observations, the present writ petition stands disposed of.
