This is a writ application of the year 2008 against the award of the Labour Court directing reinstatement for removal in violation of Section 25-F of the Industrial Disputes Act. Appeals were preferred both by the Petitioners and the Respondent. While the Petitioners challenged the reinstatement, the Respondent claimed full back wages. Both the appeals have been dismissed. 2.

A bare perusal of the order of the Labour Court and the Industrial Tribunal both reveal that there was no issue with regard to the validity of the appointment. The only issue was with regard to violation of Section 25-F of the Industrial Disputes Act before removal. It was also not in dispute that the Respondent had worked for 240 days. 3.
