This petition is against the interim order dated 27.11.2017 whereby the trial Court has directed to pay Rs.2000/- to the respondent for attending the Court case in every date of hearing, which is meant for the expenses of attendant and traveling expenses for coming from Janjgir to Mahasamund. Apart from that, Rs.2000/- has been ordered for monthly maintenance and Rs.2000/- for the cost of litigation.

Learned counsel for the petitioner submits that from Janjgir to Mahasamund the expenses to be incurred for each date is very high and unreasonable and apart from that the other maintenance award has been passed though the petitioner has no income to that extent.

After perusal of the order, I do not find any reason to interfere it except the fact that from Janjgir to Mahasamund, which is about 150 Km approximately an amount of Rs.1000/- would be sufficient

for attendant when the respondent attend the Court on hearing of the case; however, in respect of an amount of Rs.2000/- for litigation expenses and Rs.2000/- for monthly expenses, I do not find it exorbitant considering the price index prevailing in the society.

In view of this, the expenses which has been given for the attendant of the respondent in the Court for Rs.2000/- is modified to be paid to Rs.1000/- whereas in respect of the other maintenance, the same is not interfered. The trial Court is requested to expedite the trial as early as possible. 5.

With such observation, the petition stands disposed of. Sd/- (Goutam Bhaduri) Judge Ashok
