Heard on the question of admission.

The plaintiff's suit for declaration of title and permanent injunction was dismissed by the trial Court holding that the plaintiff has not perfected his title over the suit land by adverse possession. 3.

First Appeal filed by the plaintiff was dismissed affirming the finding of the trial Court.

After hearing learned counsel for the parties, I am of the view that finding of the trial Court holding that the plaintiff has not perfected his title over the suit land is the finding of fact based on evidence available on record and as such, both the Courts below have concurrently held that the suit land is the government land and the plaintiff has failed to prove the adverse possession. I do not find any substantial question of law to be formulated for decision of this appeal.

Consequently, the appeal deserves to be and is accordingly

dismissed. However, the appellant is at liberty to proceed in accordance with law.
