1. This appeal by the accused/appellant under Section 14A (2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 is directed against the order dated 06.08.2020 passed by the Special Judge (POCSO), Baloda Bazar, District Baloda Bazar - Bhatapara (C.G.) in Special Bail Application (POCSO) No. 41/2020, refusing to allow his regular bail under Section 439 Cr.P.C. The appellant is in jail since 30.07.2020 in connection with Crime No. 288/2020 for the offence punishable under Sections 363, 376, 376-D, 376 DA, 376 F, 341, 506 & 354-A of IPC; Sections 4, 6 & 8 of the Protection of Children from Sexual Offences Act; Section 3 (2) (v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 and Sections 66-D & 67 (A) (B) of the Information Technology Act, 2000, registered at Police Station Palari, District Baloda Bazar- Bhatapara (C.G.).

2. Learned counsel for the appellant seeks to withdraw this appeal with liberty to file fresh appeal as and when occasion arises.

3. Accordingly, the appeal is dismissed as withdrawn with the liberty as stated above.
