The challenge in this application is to the order dated 12.1.2001 setting aside recoveries from Respondent No.1 directed to be paid to the victim of the accident as Respondent No.1 was the driver. 3.

According to the facts, the steering of the bus failed because of which it met with an accident. Respondent No.1 was dismissed from service which was set aside by the Labour Court. The Petitioner is stated to have filed an appeal against the same, but Learned Counsel for the Petitioner is not in a position to inform the status.

The Court is not satisfied that without any finding how Respondent No.1 was at fault, recovery of the payment made to the victim was recoverable from Respondent No.1.

The Court finds no reason to interfere with the order of the Labour Court. The writ petition is dismissed.
