1) The applicant has preferred this application under Section 439 of Code of Criminal Procedure, 1973, as he was arrested on 04.01.2021 in connection with Crime No. 293/2020 for offence under Section 34 (2) of C.G. Excise Act, registered at Police Station- Pipariya, District- Kabirdham (C.G.).

2) At the outset, learned counsel appearing for the applicant seeks to withdraw this application with liberty to file a fresh application as and when occasion arises.

3) Counsel for the non-applicant has no objection to the above prayer.

4) Permission granted.

5) Accordingly, the application is disposed of as withdrawn with the liberty as stated above.
