1. The petitioner who is working as Lady Health Visitor has been transferred from Sub-Health Center, Baradwar-A, District Janjgir to Sub-Health Center, Bhilai Bazar, Block Katghora, District Korba on administrative ground vide order dated 23.08.2019, which is under challenge in this writ petition.

2. Learned counsel for the petitioner would submit that the appointment of the petitioner was made by the Chief Health and Medical Officer, Janjgir Champa on 23.11.2006, therefore, she is a district cadre employee and further she has undergone eVIN training and as per the policy of the State, the persons who were provided training are not transferred to outside the district. It is further submitted that since the seniority of the petitioner may be affected by such district-wise transfer, she has filed representation before the Director, Health Services and Family Welfare, Raipur vide Annexure P-7 which is pending

consideration. Therefore, for the time being, the said representation may be directed to be disposed of.

3. Considering the fact that the representation has already been filed wherein it refers to the Circular of the State as also it purports that by such transfer order the seniority of the petitioner would be affected, the respondents are directed to decide the representation within a period of 45 days from the date of receipt of this order.
