1. The present Contempt Petition has been filed alleging non- compliance of the order dated 28.09.2018 passed in WPS 6430 of 2018. The direction given by this Court to the Respondent No. 2 while disposing off the said writ petition was to take a decision so far as the payment of death cum retrial dues including pensionary benefits if any, payable to the petitioner.

2. The respondent have now entered appearance and filed their reply. Along with their reply, they have enclosed a document Annexure R/2 dated 25.01.2019. Perusal of the contents of the said letter shows that the same is a correspondence made by the Director to the Deputy Director of the concerned department intimating the Deputy Director that, the Department has received instruction from the High Level

Pension Committee constituted by the General Administration Department of the State whereby it has been held that the petitioner herein would be entitled for pension and other benefits as per rules. That, it was further directed to take appropriate steps in this regard.

3. The aforesaid correspondence of the Director shows that so far as the steps that could be taken at the level of Director has already been done. And as such it seems that the compliance of the order passed by this Court to that extent has been done by the respondent

4. At this juncture, the counsel for petitioner submits that, unless the petitioner finally receives the benefit, the order passed by the respondent, may not be of any use to the petitioner

5. It is expected that the respondent / concerned officer in the department would take early steps for finalization of the same.
