1. The limited prayer which the petitioner at this juncture makes is for disposal of the writ petition with a direction to the respondent No.2 to consider the case of the petitioner for appointment as Angan Badi Worker subject to their fulfilling the eligibility conditions and criteria required for the post of Angan Badi Worker particularly keeping in view the service rendered by the petitioners as Angan Badi Sikshika in Shishu Shiksha Kendra run by the School Education Department.

2. Learned counsel for the petitioner submits that the Government has framed a policy in this regard vide circular dated 03.03.2010 (Annexure P/5) wherein it has been envisaged that the Shikshikas

engaged at Shishu Shiksha Kendra may be considered for appointment as Angan Badi Workers subject to their fulfilling the eligibility criterias for the said post. The petitioner further submits that the upper age limit would not be barrier for appointment to the above post of Angan Badi Workers from among the Shikshikas in the Shishu Shiksha Kendras of the State Govt.

3. The request of the petitioners is not opposed by the State counsel.

4. Accordingly, the present writ petition stands disposed of with a direction to the respondent No.2 to consider and decide the claim of the petitioners for appointment to the post of Angan Badi Workers keeping in view the policy decision of the State Govt. dated 03.03.2010.

5. It is made clear that this court has not expressed any opinion on the merits of the case reserving the right of the respondents to decide the claim of the petitioner purely in accordance with rules and guidelines framed by the Government in this regard particularly the policy decision dated 03.03.2010 or any other circular in vogue.

6. Considering the fact the present petition is of the year, 2011, it is expected that the respondent No.2 shall consider and decide the claim of the petitioners within an outer limit of 90 days from the date of production of certified copy of this order.

7. With the aforesaid observations, the writ petition stands disposed of. Sd/- (P. Sam Koshy) Judge inder
