This is second bail application under Section 439 of Cr.P.C. The earlier bail application was dismissed on 17/01/2017 vide M.Cr.C. No.71/2017.

The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.450/2016 registered in Police Station Civil Lines, Distt.-Raipur for offence punishable under sections 170, 419, 420, 467 and 468 of IPC.

Case of the prosecution, in brief, is that a report was made against the applicant that in between 3/08/2016 and 5/08/2016 the applicant projecting himself as IPS Officer of Intelligence Bureau on the basis of Identity Card of IB got room booked in hotel and thereafter used the vehicle, engaged different officials and also used to stay in the hotel. Subsequently, applicant's fake ID card was seized which was not issued by the Intelligence Bureau and thereby the aforesaid offence was committed.

Learned counsel for the applicant submits that the applicant is in jail since 6/08/2016 i.e. near about 3 1⁄2 years he has spent in jail and out of 17 witnesses only 7 witnesses have been examined, offence is triable by JMFC and considerable delay has caused, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 6.

Considering the fact that the applicant is in jail since 6/08/2016 and out of 17 witnesses only 7 witnesses have been examined, offence is triable by JMFC and considerable delay has caused, therefore this court is inclined to release the applicant on bail.

Accordingly, the second bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
