1. Heard on application for urgent hearing.

2. Learned counsel for the petitioner had challenged the order dated 16.02.2015 and 29.01.2016 issued by Respondent No. 2 & 3 whereby the petitioner was relieved assigning designation of Assistant Grade- III from

State of C.G. to State of M.P on account of regularization. It is stated that the petitioner was promoted to Assistant Grade - I and on allocation of petitioner to State of M.P. his post cannot be lowered down from Assistant Grade-I to Assistant Grade -III.

3. The additional submission that is filed by the State, which is supported by the affidavit shows that the order dated 29.01.2016 and 16.02.2015 has been modified and the consequent modified orders has been passed whereby the petitioner has been relieved as Assistant Grade -I. In view, of this no further relief can be granted to the petitioner. The petition has become infructuous.

4. In view of the submission made of the State, the petition is dismissed as having become infructuous.
