2. Learned counsel for the petitioner submits that now Food and Safety Appellate Tribunal has been constituted therefore, petitioner be given the permission to withdraw this writ petition (criminal) with liberty to file an appeal before the said Appellate Tribunal.
3. As prayed for, petitioner is permitted to withdraw this writ petition (criminal) with liberty to file an appeal before the said Appellate Tribunal within 7 days from today. If such an appeal is preferred by the petitioner within the stipulated time, learned Food and Safety Appellate Tribunal is directed to hear and decide the appeal preferably within a period of one month from the date of filing of the appeal and during that period, the interim order granted by this
Court on 23/08/2017 shall remain in force.
4. With the aforesaid observations, this writ petition (criminal) stands disposed of. No cost(s). Certified copy be returned after furnishing attested copy thereof.
5. A copy of this order be sent to the Food and Safety Appellate Tribunal by e-mail/fax.
