Hon'ble Shri Justice Pritinker Diwaker Order On Board 05/08/2015 1.

Challenge in the present writ petition is to the order dated 20.04.2009 (Annexure P/1) passed by the Board of Revenue, Circuit Court, Raipur by which the revision preferred by the petitioner was dismissed by the Board of Revenue upholding the order dated 18.02.2008 passed by the Collector arising out of mutation proceeding.

Learned counsel for the petitioner submits that in relation to land in question, the civil suit has already been filed by the respondent No.4 and the same is at the evidence stage and

therefore, at this stage the petitioner may be permitted to withdraw this petition with liberty to raise all the points in the civil suit which have been raised in the writ petition. 3.

Learned counsel appearing for respondents have no objection to the proposition put forth by the petitioner.

Accordingly, the petition is dismissed as withdrawn with aforesaid liberty.

It is made clear that nothing has been observed by this Court on merit aspect of the case and the competent Court having civil jurisdiction would be free to decide the civil suit in accordance with law.
