Hon'ble Shri Navin Sinha, Chief Justice Order on Board 22/02/2016 1.

The grievance of the Petitioner is with regard to denial of promotion even while his juniors were promoted to the post of Superintending Engineer (T&D). 2.

The counter affidavit was served on 23.2.2009. Paragraph-4 specifically states that the Petitioner was penalized and punished in a disciplinary proceeding withholding two increments with cumulative effect and for that reason

his case could not be considered when his juniors were promoted as the punishment was then in operation. There is no rejoinder to the counter affidavit. 3.

Presumably, the Petitioner has lost interest in the matter. The writ petition is dismissed for non-prosecution.
