Hon'ble Shri Justice P. Sam Koshy Order On Board 14/07/2015 The appellant in the instant case has been convicted for the offence under Section 376 (2) (g) read with Section 511 and 450 of IPC and sentenced to undergo rigorous imprisonment for five years with fine of Rs. 1,000 u/s 376 (2) (g) and two years with fine of Rs.1,000 u/s 450 IPC, with default stipulations.
P.U.D. dated 16.11.2009 received from the Jail Superintendent, Central Jail, Durg reflects that th ough the appellant was granted bail by this Court on 18.06.2009, he has refused to furnish bail and expressed to undergo the entire jail sentence imposed on him. State counsel submits that today, she has telephonically received information from the Jail Superintendent, Central Jail, Durg that after serving the entire jail sentence the Appellant has already been set fee on 16.12.2010.
In view of the submission made by the State counsel, the appellant has undergone the entire sentence imposed on him, it appears that he is not interested to prosecute this appeal.
Accordingly, the instant appeal stands dismissed. However, the appellant is left free to file a suitable application for revival of the appeal if occasion so arises.
