The grievance was with regard to an advertisement in the year 2007 for appointment on the post of Electrician. It was alleged that person below the Petitioner had been appointed.

The counter affidavit was served as far back on 21.7.2009. It states that the list of candidates called for interview has wrongly been interpreted as the merit list. Respondent No.3 was found better qualified on merit and was placed above the Petitioner in the merit list. There is no denial by rejoinder. 3.
