NAFR HIGH COURT OF CHHATTISGARH, BILASPUR Writ Petition (S) No.6944 of 2008 Rohit Kumar Kashyap, aged about 22 years, S/o Ishwar Singh Kashyap, R/o Village Mohtara, Post Khondsara, Tahsil Bemetara, District Durg (Chhattisgarh) ---- Petitioner versus

1. State of Chhattisgarh, through the Secretary, Department of Panchayat Rural Development, D.K.S. Bhawan, Raipur (Chhattisgarh)

2. The Collector, Durg, District Durg (Chhattisgarh)

3. Jila Panchayat Durg through Chief Executive Officer, District Durg (Chhattisgarh)

4. Janpad Panchayat Nawagarh through the Chief Executive Officer, District Durg (Chhattisgarh) ---- Respondents For Petitioner :

Ms. Anita Suryavanshi, Advocate For State/Respondents No.1 & 2 :

Shri Prafull N. Bharat, Additional Advocate General Hon'ble Shri Navin Sinha, Chief Justice Order on Board 22/01/2016 1.

Heard Learned Counsel for the Petitioner and the State. 2.

The impugned order dated 25.8.2008 reflects full compliance with the principles of natural justice by affording proper opportunity of hearing and defence to the Petitioner. The counter-affidavit states that a show cause notice was issued on 16.2.2008. The Petitioner submitted his reply. His statement was also recorded. The teaching experience certificate and the sport certificate submitted by the Petitioner on basis of which he was given marks by the selection committee and he came to be appointed as a Shiksha Karmi were forged and fabricated. Once it has been established in an inquiry with due opportunity of hearing that the certificates were forged and fabricated and he took the defence that he is not aware how the certificates came to be annexed to his application, the Petitioner being the sole beneficiary, the Court finds no reason to interfere with the impugned order with regard to termination of the appointment obtained by forgery and deceit. 3.

The writ petition is dismissed.
