3. Ghanshyam Singh Saluja S/o Late Kartar Singh Saluja R/o Basna, Tahsil Basna , District Mahasamund Chhattisgarh ---- Respondents For Petitioner :
Mr. Nasimuddin Ansari, Advocate For State :
Mr. Somkant Verma, PL Hon'ble Shri Justice P. Sam Koshy Order on Board 20/01/2020
1. The limited relief that the petitioner has sought for in the present writ petition is for an appropriate direction to the respondent No.2 to consider and decide the case No.77/2018-19, Class B-121 at the earliest.
2. Contention of the petitioner is that he was raising some construction over his land which was objected to by the respondent No.3 and subsequently respondent No.2 had ordered for stay of the construction and further directed the patwari to submit a report. According to the petitioner the patwari has since submitted the report in favour of the petitioner holding that there is no encroachment
made by him and therefore the petitioner now wants respondent No.2 to decide the said case at the earliest.
3. To this limited relief sought for by the petitioner, State counsel does not have any objection.
4. Accordingly, the writ petition stands disposed of directing the respondent No.2 to decide the case No.77/2018-19, Class B-121 at the earliest preferably within a period of 60 days from the date of receipt of copy of this order.
