1. Proceedings of this matter have been taken up through video conferencing.

2. Learned counsel for the petitioner submits that petitioner has made representation to the

respondent authority for consideration of his case for promotion to the post of Chief Engineer on 26.10.2009 but it has not been considered as per applicable rules and thereby has been denied to consider the matter of promotion, as such, the appropriate direction be issued to the respondents to consider the representation of the petitioner made on 26.10.2009.

3. Prayed is fair and reasonable.

4. Respondent No.1 & 2 are directed to consider and decide the petitioner's representation within 45 days from the date of receipt of copy of this order by passing a reasoned and speaking order. Petitioner is at liberty to make fresh representation. However, it is made clear that this Court has not expressed any opinion on the merits of the case.

5. With the aforesaid observation / direction the instant writ petition stands disposed off.
