The dispute in the instant Writ Petition is in respect of difference of pay which the petitioner would be entitled for during the period 09/10/2006 to 10/05/2011.

The actual dispute which the petitioner is aggrieved of is that, the petitioner though was appointed in the clerical cadre under the respondent No.1, but was paid the wages of Siksha Karmi-Grade-III i.e. the scale of 2700-3700/- whereas the scale of pay for the clerical cadre was infact 30504590/-.

According to the counsel for the petitioner, the petitioner had brought this fact to the notice of the authorities in the department who immediately rectified the pay-scale granted and from 11/05/2011 onwards, the petitioner is being paid the pay-scale of 3050-4590/- and that now the only dispute remains is that of arrears of difference of pay for the period between 09/10/2006 to 10/05/2011. He further contended that, the petitioner has been repeatedly approaching the authorities in the department, but no relief has been given to the petitioner by the respondent and the representation also till date have not been rejected in any manner.

Given the aforesaid facts and circumstances of the case, let the respondents No. 1 & 2 take a decision on the entitlement of the petitioner so far as the arrears of pay is concerned for the aforesaid period and in this regard the respondents No. 1 & 2 should pass an appropriate order at the earliest preferably within a period of 90 days from the date of receipt of copy of this order.
