Learned Counsel for the State submits that the Petitioner has not even mentioned his date of appointment. He claims his date of birth as 14.3.1959. There is no pleading what was the date of birth recorded in service book. 3.

The pleadings in the writ application are completely vague and unsubstantiated. Reliance by the Petitioner on Rule 84 and 85 of the Chhattisgarh Financial Code is highly misplaced in view of the observations in (2011) 9 SCC 664 (State of Madhya Pradesh v. Premlal Shrivas) in paragraphs 12, 13 and 14.
