Shri Vijay K. Deshmukh with Curtis Collins, Advocates Hon'ble Shri Justice P. Sam Koshy Order On Board 16/07/2018 The dispute raised by the petitioner in the present writ petition is the charge which was ordered to be handed over to respondent no.5 vide an order of respondent no.4 dated 22.03.2012.

Counsel for the petitioner submits that it is the competency of the officer which is under challenge in the present writ petition in as much as the Block Education Officer was not the competent officer to take the charge from the petitioner and give it to respondent no.5. 3.
Perusal of the record shows that the writ petition was filed in the year 2012 and by this time, almost 6 years has lapsed from the date of issuance of the impugned order and much water must have flown in between. 4.
Given the facts and circumstances of the case, this Court does not intend to keep the petition pending rather ends of justice would meet if the writ petition is disposed of with a direction to respondent no.2, the Mission Director under Rajiv Gandhi Shiksha Mission to consider the grievance of the petitioner so far as handing over the charge to respondent no.5 is concerned and pass a suitable order in accordance with the provisions of the scheme and also the rules governing the field. 5.
The petitioner would be at liberty to file a fresh representation to respondent no.2 in this regard within a period of 15 days from today on which the respondent no.2 shall take a decision at the earliest preferably within a period of 60 days from the date of receipt of the said representation. 6.
