Proceedings through Video Conferencing Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 16/06/2020

1. The applicant has preferred this application for grant of anticipatory bail, as he apprehends his arrest in connection with Crime No.612/2019, registered at Police Outpost - Lavan, under Police Station Kasdol, District- Baloda Bazar, C.G. for offences punishable under Sections 409, 420, 34 of the IPC.

2. It it alleged that four office bearers of Agricultural Co-Operative Society, Lahoud have been booked for committing offences punishable under Sections 409, 420, 34 of the IPC. They had

MCRCA No. 106 of 2020 allegedly unloaded 161 gunny bags of paddy and then loaded 117 bags of HMT rice without any token in the premises of the said Society and thereby caused misappropriation of paddy and committed forgery.

3. Admittedly, co-accused - Narendra Sahu has been granted anticipatory bail by this Court in MCrCA No.1628 of 2019.

4. Learned State Counsel would oppose the prayer for grant of bail.

5. Considering the nature of allegation and for the fact that the coaccused - Narendra Sahu has already been granted anticipatory bail by this Court, the present applicant is entitled to be released on anticipatory bail.

6. Accordingly, the application is allowed and it is directed that in the event of arrest of the applicant, he shall be released on anticipatory bail on his executing a personal bond for a sum of Rs.50,000/- with one surety in the like sum to the satisfaction of the arresting officer with the following conditions:- (i) he shall make himself available for interrogation by a police officer as and when required;

(ii) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer. SD/- (Prashant Kumar Mishra) Judge Ayushi
